Supreme Court Throws Out New York Gun Case, Avoiding Major Second Amendment Ruling | National News | US News

THE SUPREME COURT ON Monday threw out a gun rights case from New York, avoiding what would have been the first major Second Amendment ruling in a decade.

The court dismissed the case as moot in an unsigned decision, but three conservative justices filed a dissent.

The case centers on now-rescinded New York City rules barring citizens who have a permit to keep a gun in their homes from transporting firearms to firing ranges outside the city or to a second home in the state. Three people and the New York State Rifle and Pistol Association, an affiliate of the National Rifle Association, filed a lawsuit arguing that the restrictions were unconstitutional.

The city threw out the restrictions after the Supreme Court agreed to hear the case, and the state of New York then passed a law that would prevent the rules from being reenacted in the future. Those efforts were widely considered acquiescence on the part of the city, and were seen by some as an attempt to render the case moot and prevent the Supreme Court from issuing a major Second Amendment decision.

The court’s brief, two-page decision Monday only stated that the case was now moot. Justice Samuel Alito Jr. dissented, joined by Justices Clarence Thomas and Neil Gorsuch.

“By incorrectly dismissing this case as moot, the court permits our docket to be manipulated in a way that should not be countenanced,” Alito wrote.

Justice Brett Kavanaugh wrote to say he agreed with the majority’s opinion but said similar gun rights issues deserve attention from the court.

“The court should address that issue soon, perhaps in one of the several Second Amendment cases with petitions for certiorari now pending before the court,” Kavanaugh wrote.

The case was the first gun rights case the court agreed to hear since the retirement of former Justice Anthony Kennedy, and the addition of Gorsuch and Kavanaugh to the court.

Though the case was extremely narrow in scope, Second Amendment advocates were hopeful that the court would use the case to say something broader about gun rights.

During the American Revolution, the legal separation of the Thirteen Colonies from Great Britain in 1776 actually occurred on July 2, when the Second Continental Congress voted to approve a resolution of independence that had been proposed in June by Richard Henry Lee of Virginia declaring the United States independent from Great Britain’s rule.[5][6] After voting for independence, Congress turned its attention to the Declaration of Independence, a statement explaining this decision, which had been prepared by a Committee of Five, with Thomas Jefferson as its principal author. Congress debated and revised the wording of the Declaration, finally approving it two days later on July 4. A day earlier, John Adams had written to his wife Abigail:

The second day of July, 1776, will be the most memorable epoch in the history of America. I am apt to believe that it will be celebrated by succeeding generations as the great anniversary festival. It ought to be commemorated as the day of deliverance, by solemn acts of devotion to God Almighty. It ought to be solemnized with pomp and parade, with shows, games, sports, guns, bells, bonfires, and illuminations, from one end of this continent to the other, from this time forward forever more.

Sparkler and Fireworks Safety

More than 50,000 fires are caused by fireworks every year. Take the proper precautions when operating fireworks.

  • Never disassemble or try to make your own fireworks.
  • Don’t point sparklers, or fireworks at yourself or others, especially while they’re being lit.
  • Only light fireworks on the ground and in areas that are dry and fire resistant.
  • Don’t attempt to light multiple devices at the same time.
  • Never allow young children to handle fireworks or sparklers.
  • Always keep a portable fire extinguisher close by. Also keep a water hose or buckets of water nearby to put out fires.

Water Activity Safety

As July is one of the hottest months of the year, many families turn to water activities to beat the heat. However, even fun water activities have serious risks if the proper precautions aren’t taken.

  • Review safe boating practices.
  • Never consume alcohol while driving a boat.
  • Before boating, always check that there are enough life preservers on hand for every passenger.
  • Set water safety rules for your family.
  • Pools should be enclosed completely with a fence to restrict access to the area. Consider installing wireless outdoor sensors that will alert you via phone or with a chime inside your home if the sensors are activated.
  • Keep a first aid kit near the pool.

Grilling Safety

  • Check gas grill hoses for cracks, holes and leaks.
  • Keep children away from grills. Gas leaks, blocked tubes, and propane tanks can be a cause of grill fires and explosions.
  • Never grill indoors, in the garage, in any enclosed area or on a surface that might catch fire.
  • Keep the grill at least two feet away from decks, siding, branches and any outdoor equipment that can catch fire quickly.

John Hickenlooper releases plan to reduce gun violence – CBS News

Democratic presidential candidate and former Colorado Gov. John Hickenlooper released a set of proposals Wednesday to curb gun violence, including a call for national gun licenses and raising the legal age to own a firearm. Here are some of the initiatives he’s proposing, some of which are based on legislation he signed into law as governor:

  • Universal background checks: Hickenlooper is calling for national background checks for all gun sales, pointing out that one in five gun purchases do not undergo checks because of existing loopholes. He wants to close loopholes and extend the current three-day waiting period to 10 days in order to close what’s known as the “Charleston loophole,” which enabled Dylann Roof to purchase guns he used to kill nine parishioners in a black church in 2015.
  • National gun licenses: Gun owners would be required to obtain a national gun license that would also require a background check. The license would need to be renewed online every five years.
  • Raise minimum age to own a gun to 21: Currently, individuals in the U.S. who are at least 18 years of age may own a gun. Licensed firearms sellers may sell handguns to people who are not under 21 years old. But unlicensed people may sell or transfer handguns to people who are 18 years of age.
  • Encourage extreme risk protection orders: Would give grants to states to encourage them to put laws on the books allowing families and law enforcement to remove — temporarily — a person’s access to guns in order to prevent gun violence, if there are warning signs that the individual poses a danger. Such laws have been passed in Colorado and 14 other states, according to a release from the Hickenlooper campaign.
  • Magazine limits and bump stocks: Hickenlooper passed magazine limits in Colorado and is pushing for similar action nationwide. He’s also calling for Congress to codify the Justice Department’s interpretation of a rule to effectively ban bump stocks, which are used to make legal firearms function in a manner similar to automatic weapons.
  • Assault weapons ban: Calls for renewal of assault weapons ban, which was passed in 1994 and expired in 2004. Some in Congress have tried to renew the ban and failed. Hickenlooper acknowledged in his press release the problems with the earlier ban, noting that gun manufacturers found ways to evade the ban. He believes that the ban introduced by Democrats this year addresses many of the shortcomings of the prior bill.
  • Boost access to mental health services for children: School-based mental health services and community health centers can help identify and support students “who require more intensive services or…law enforcement intervention,” the campaign’s press release noted.

Hickenlooper has few friends at the NRA — he received an “F” rating from the NRA Victory Fund, which states on its website: “Make no mistake about it, Governor Hickenlooper is anti-gun and actively seeks to diminish Second Amendment rights in Colorado and throughout the nation.”

Other 2020 Democratic contenders are also weighing in on guns. Last week, California Sen. Kamala Harris announced plans to ban AR-15-style firearm imports. New Jersey Senator Cory Booker recently released a gun plan that also calls for a licensed gun ownership program.

In 2018, over 22,000 people died from firearm suicides in 2016, according to a CDC report.

This Day in History – What Happened Today – the Continental Congress adopts the flag of the United States

During the American Revolution, the Continental Congress adopts a resolution stating that “the flag of the United States be thirteen alternate stripes red and white” and that “the Union be thirteen stars, white in a blue field, representing a new Constellation.” The national flag, which became known as the “Stars and Stripes,” was based on the “Grand Union” flag, a banner carried by the Continental Army in 1776 that also consisted of 13 red and white stripes. According to legend, Philadelphia seamstress Betsy Ross designed the new canton for the Stars and Stripes, which consisted of a circle of 13 stars and a blue background, at the request of General George Washington. Historians have been unable to conclusively prove or disprove this legend.

With the entrance of new states into the United States after independence, new stripes and stars were added to represent new additions to the Union. In 1818, however, Congress enacted a law stipulating that the 13 original stripes be restored and that only stars be added to represent new states.

On June 14, 1877, the first Flag Day observance was held on the 100th anniversary of the adoption of the Stars and Stripes. As instructed by Congress, the U.S. flag was flown from all public buildings across the country. In the years after the first Flag Day, several states continued to observe the anniversary, and in 1949 Congress officially designated June 14 as Flag Day, a national day of observance.
